Current governing laws on labor issues in China

   The basic principles of labor laws and labor management in China are set out in the following legislation:

  1. The Labor Law of the People's Republic of China (hereinafter referred to as China Labor Law), adopted by the eighth session of the Standing Committee of the Eighth National People's Congress on 5th July 1994 and effective from 1st January 1995;
  2. The Labor Contract Law of the People's Republic of China, promulgated by the Standing Committee of the NPC on 29 June 2007 and effective from 1st January 2008;
  3. The National Trade Union Law of the People's Republic of China, initially promulgated on 28th June 1950, revised on 3rd April 1992 and subsequently on 17th October 2001;
  4. The Law of the People's Republic of China on Mediation and Arbitration of Labor Disputes, adopted by the Standing Committee of the NPC on 29th December 2007 and promulgated by the China Chairman on the Same day and effective from 1st May 2008
  5. The Law of the People's Republic of China on the Protection of Woman's Rights and interests issued in 1992 and revised in 2005;
  6. The Law of the People's Republic of China on the Protection of Minors, issued in 1991 and revised in 2006;
  7. The Law of People's Republic of China on Production Safety, issued in 2002;
  8. The Law of the People's Republic of China on the Prevention and Treatment of Work-related Diseases, issued in 2001.
